Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and WayTogether (see Section 13 for our identifying details) governing your access to and use of the WayTogether mobile application and related services (the "Service").

By creating an account or otherwise using the Service, you confirm that you accept these Terms and our Privacy Policy, and that you agree to comply with them. If you do not agree, you must not use the Service.

WayTogether is a platform that helps users find compatible travel companions based on a self-reported "Travel DNA" compatibility profile, trip details, a swipe-based discovery mechanism, and in-app messaging between matched users.

WayTogether does not organize, supervise, or participate in any trip, meeting, or activity arranged between users, and is not a party to any agreement users make with each other.

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

You may not use the Service if you have previously been removed from the Service by us, or if you are barred from using the Service under applicable law.

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate, current, and complete information in your profile and trips, and to keep that information up to date.

You may delete your account at any time from within the app (Settings → Delete Account) or by contacting us — see our Privacy Policy for what deletion does and does not remove.

When using the Service, you agree that you will not:

• Provide false, misleading, or impersonating information in your profile, photos, or trips.
• Harass, threaten, stalk, defame, or otherwise abuse another user, whether inside or outside the app.
• Use the Service for any commercial solicitation, advertising, spam, or unauthorized promotional purpose.
• Upload content that is unlawful, sexually explicit, hateful, violent, or that infringes the intellectual property or privacy rights of any person.
• Attempt to circumvent, disable, reverse-engineer, or interfere with the security or proper functioning of the Service.
• Use automated means (bots, scrapers) to access or collect data from the Service.

The Service allows you to block or report other users directly from their profile or a shared conversation. We review reports and may, at our sole discretion, warn, suspend, or permanently remove any account that we determine has violated these Terms.

You retain ownership of the photos, bio, messages, and other content you submit to the Service ("User Content"). By submitting User Content, you grant WayTogether a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service to you and the users you match with.

You represent that you own or have the necessary rights to the User Content you submit, and that it does not infringe any third party's rights.

WayTogether helps you find potential travel companions but does not conduct criminal background checks or otherwise verify users, and cannot guarantee the identity, intentions, or conduct of any user. You are solely responsible for your interactions with other users, on and off the Service.

• Never send money, financial information, or sensitive documents to someone you met through the Service.
• Get to know someone through the app before meeting in person, and arrange initial meetings in a public place.
• Tell a friend or family member your travel plans and who you are meeting.
• Trust your instincts — if something feels wrong, remove yourself from the situation and report the user to us.

We do not guarantee that you will find a match, that any match will result in a successful trip or relationship, or that any information provided by another user is accurate. Compatibility scores are indicative only and based on self-reported data.

We may suspend or terminate your access to the Service, at our sole discretion and without prior notice, if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason permitted by applicable law.

You may stop using the Service and delete your account at any time, as described in Section 4.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any defect will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAYTOGETHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS — INCLUDING ANY IN-PERSON MEETING OR TRIP ARRANGED THROUGH THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death, personal injury, fraud, or gross negligence.

Chris Moll, an individual based in the province of Utrecht, the Netherlands, operating WayTogether as a sole individual (not yet registered with the Dutch Chamber of Commerce (KVK) — this notice will be updated with a KVK registration number once WayTogether becomes a registered business).

We may update these Terms from time to time as the Service evolves or as required by law. Where changes are material, we will provide additional notice (e.g. in-app) before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Disputes will be submitted to the exclusive jurisdiction of the competent Dutch court — CONFIRM which specific court/district (e.g. based on your registered address once you have a KVK registration) before publishing; this was left general since Baarn's competent district court depends on details I don't have.
